Crimes are usually categorized as felonies or misdemeanors based on their nature and the maximum punishment that can be imposed. A felony involves serious misconduct that is punishable by death or by imprisonment for more than one year.

The court sentencing guidelines take into account both the seriousness of the offense and the offender’s criminal history, as well as mandatory sentencing guidelines, including federal criminal sentencing guidelines and federal prison sentencing guidelines for federal cases. State guidelines are based upon similar criteria.
